What You Should Know About Our Privacy Practices, Data Protection Measures, and Your Rights
1. Introduction
CloudBooster (“we”, “our”, or “us”) values the privacy of our customers. This Privacy Policy explains how we collect, use, store, and protect your personal data when you use our platform. By using CloudBooster, you agree to the terms outlined in this policy.
2. Information We Collect
Personal Information:
We collect personal data such as your name, email address, phone number, and billing details (including address, payment method) necessary for providing our services.
Technical Information:
We may collect information about your device and browser, such as IP addresses, cookies, and device information, to improve the performance and functionality of our platform.
Cloud Provider Account Data:
To connect and manage services within your cloud provider account (e.g., Google Cloud), you will provide access to your cloud account. This allows us to manage specific resources on your behalf, but the ownership of the account and its data remains with you.
Customer Environments:
As part of the professional cloud services we provide, we may need to access and manage customer environments (including those not directly managed by CloudBooster) for purposes such as migration, management, troubleshooting, and optimization of cloud resources.
This access is granted with customer consent and under the terms of our service agreements. We implement strict security measures to ensure that this access is granted securely and under controlled conditions.
Intellectual Property:
During the course of providing services, we may have access to customer configurations, source code, and other intellectual property (IP). This information is treated as confidential and is used solely for the purposes of delivering the agreed-upon services.
CloudBooster acknowledges that all IP provided by customers remains the property of the customer. We will not share or use your IP for any purpose other than as part of the services unless authorized by the customer in writing.
Sensitive Information:
As part of managing your cloud resources, we may have access to sensitive information stored within your cloud accounts, including customer details and other data. We treat all such data as confidential and have processes in place to prevent misuse, exposure, or unauthorized access.
3. Use of Information
We use your data to:
- Provide and manage services on the platform
- Process payments through third-party providers
- Improve the functionality and performance of our platform
- Communicate with you regarding platform updates and support
We will not use your data for any purposes beyond those stated above without your explicit consent.
4. Data Storage and Security
All data is stored securely within cloud provider resources owned by CloudBooster.
Your data is encrypted at rest and in transit, and we employ strict access controls to protect it from unauthorized access or disclosure.
5. User Rights and Control
In compliance with GDPR regulations, you have the following rights regarding your personal data:
- Right to Access: You may request a copy of the personal data we hold about you.
- Right to Rectification: You can request corrections to any inaccuracies in your data.
- Right to Erasure: You can request the deletion of your personal data under certain conditions.
- Right to Restrict Processing: You may ask us to restrict the processing of your personal data under specific circumstances.
- Right to Data Portability: You can request a copy of your data in a structured, commonly used format.
- Right to Object: You can object to the processing of your personal data in certain cases.
To exercise these rights, please contact us via the contact details provided below.
6. Third-Party Data Sharing
We do not sell or share your personal data or intellectual property with third parties, except as necessary for providing our services or as required by law. Any access to customer environments or IP is strictly for the purpose of delivering CloudBooster’s services and is governed by non-disclosure agreements and service contracts.
7. Data Retention
We retain your personal data as long as your account remains active on the platform. Upon account closure or upon your request, we will delete or anonymize your data, subject to any legal obligations we may have. Any data or intellectual property provided by customers for the purpose of delivering services will be retained only for as long as necessary to fulfill the purpose of the service, unless otherwise agreed in the service contract.
8. Cookies and Tracking
We use cookies to improve your experience with the platform, such as remembering your preferences and providing a better user experience. You can manage your cookie preferences through your browser settings.
9. Compliance with GDPR
As we are based in the EU, we are committed to complying with the General Data Protection Regulation (GDPR). This ensures that your personal data is processed lawfully, transparently, and securely.
10. Limitation of Liability
To the fullest extent permitted by applicable law, CloudBooster’s liability for any claims, damages, or losses arising out of or in connection with the use of the platform or services, including any data breaches, unauthorized access, or loss of data, shall be limited to the amount paid by you for the specific service or subscription during the 12-month period immediately preceding the claim.
In no event shall CloudBooster be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, data, or business opportunity, even if CloudBooster has been advised of the possibility of such damages.
CloudBooster shall not be liable for any additional costs incurred by the customer, including but not limited to increased usage or resource costs, due to configurations or actions taken via the platform (e.g., the creation of additional cloud instances or resources resulting in overspending). It is the customer’s responsibility to monitor and manage their resource usage and associated costs, and to ensure that their configurations align with their budget and usage requirements.
This limitation of liability applies regardless of the cause of action, whether in contract, tort (including negligence), or any other legal theory.
